Vladimir Soloviev and Boris Chicherin: law, morality and some philosophical questions of criminal law
Annotation

The article discusses two philosophical approaches to the analysis of the basic concepts and principles of law: just retribution, guilt, responsibility, free will, on which legal science is based. One point of view is presented by Vladimir Solovyov. It is based on the doctrine of the unity of law and morality, while the law is understood as a certain ethical minimum, as a certain minimum of morality necessary in society so that life in it does not turn into Hell. From these positions he rethinks the basic concepts of criminal law and shows the illegality and complete immorality of the institution of the death penalty. Boris Chicherin proceeds from the fact that law and morality are quite autonomous areas of society. The basis of law is the principle of justice, fair reward, whereas the basis of morality is the principle of love and duty. It is the separation of law from morality that allows for the moral autonomy of the individual and its freedom. But freedom and responsibility are inseparable. Recognition of individual freedom, free will inevitably leads to an understanding of guilt as a personal guilt of an individual.
